Landlord Vision Affiliate Programme Terms and Conditions
These terms govern the Landlord Vision affiliate programme. Joining the programme, or continuing to take part after these terms take effect, means you accept them.
1. About these terms
1.1 The affiliate programme is run by Landlord Vision Ltd ("Landlord Vision", "we", "us", "our").
1.2 These terms form an agreement between Landlord Vision and you, the person or business accepted onto the programme ("you", "the Affiliate").
1.3 The programme is managed through FirstPromoter, a third-party platform. You must also follow FirstPromoter's own terms when using your affiliate console.
2. Definitions
- Affiliate Link: the unique tracking link, code or URL given to you in your affiliate console.
- Referred Customer: a new customer who buys a paid Landlord Vision subscription after visiting our website through your Affiliate Link, and who was not already a customer or trial user.
- Qualifying Payment: a full monthly or annual subscription payment that we have collected in full from a Referred Customer and that has not been refunded, reversed or charged back.
- Commission: the payment due to you under section 5.
- Brand Terms: "Landlord Vision", "LandlordVision", "LV" when used to refer to us, "landlordvision.co.uk", and any misspelling, variation or combination of these with other words (for example "Landlord Vision login" or "Landlord Vision discount").
- Paid Advertising: any advertising that you, or anyone acting for you, pays for, including pay-per-click (PPC) search ads (such as Google Ads, Microsoft Advertising (Bing), Yahoo or DuckDuckGo ads), paid social ads, display and retargeting ads, sponsored posts and sponsored listings.
3. Joining the programme
3.1 The programme is free to join. You apply through our FirstPromoter sign-up page.
3.2 Manual approval: our team reviews and approves every application manually before an account is activated. You cannot earn commission until we have approved your account. We may ask how and where you plan to promote Landlord Vision before deciding.
3.3 We may accept or decline any application at our discretion and do not have to give a reason.
3.4 Known offenders: we will decline applications from any person or business that has broken these terms, been removed from the programme, or used Paid Advertising or brand bidding to earn commission, here or in another affiliate programme we know of. This applies to applications made under a different name, email address, business or account. If we find that a blocked person has rejoined, we may close the account immediately and cancel all commission on it.
3.5 You must give accurate information when you apply and keep your contact and payment details up to date in your affiliate console.
3.6 You must be at least 18 years old. If you apply on behalf of a business, you confirm you have authority to accept these terms for it.
3.7 You may hold only one affiliate account unless we agree otherwise in writing.
4. Affiliate links and tracking
4.1 Referrals are tracked through your Affiliate Link using a cookie that lasts 1 year from the visitor's last click on your link.
4.2 If a visitor clicks links from more than one affiliate, the referral is credited to the affiliate whose link was clicked last.
4.3 Tracking relies on the visitor's browser accepting cookies. We are not responsible for referrals that cannot be tracked because cookies were blocked or deleted, or because the visitor used a different device or browser.
4.4 Our tracking records, and FirstPromoter's, are final in deciding whether a referral is credited to you.
5. Commission
5.1 Monthly subscriptions: you earn 20% commission on each of the first 12 Qualifying Payments made by each Referred Customer.
5.2 Annual subscriptions: you earn 20% commission on the Referred Customer's first upfront annual payment. This commission is paid once only. No commission is payable on annual renewals or any later annual payments.
5.3 Commission is calculated once the full monthly or annual payment has been collected from the Referred Customer. It is based on the amount actually paid, excluding VAT, after any discounts.
5.4 If a payment is refunded, reversed or charged back, in full or in part, the related commission is cancelled or reduced in proportion. If it has already been paid to you, we will deduct it from your future commission or ask you to repay it.
5.5 No commission is payable on monthly payments after a Referred Customer's 12th Qualifying Payment, on annual renewals, or on referrals that break these terms (see sections 8 to 10).
6. Payment
6.1 Approved commission is paid on the 30th of each month, to the bank account or PayPal account in your affiliate console. There is no minimum payment threshold.
6.2 Commission on a referral flagged for review under section 10 is held until the review is complete. It is not approved or paid while the review is open.
6.3 You are responsible for any tax, including VAT and income tax, due on your commission. If you are VAT registered, you must give us a valid VAT invoice before we pay any VAT.
6.4 We are not responsible for payments delayed or lost because your payment details are wrong or out of date.
6.5 If you have a question about a payment, contact us within 90 days of the payment date.
7. How you can promote Landlord Vision
7.1 You may promote Landlord Vision through channels you own or control and where your audience knows who you are, for example:
- your website, blog or newsletter
- your social media profiles and organic (unpaid) posts
- YouTube videos, podcasts, webinars and courses
- emails to people who have agreed to hear from you
7.2 You may use the ready-made marketing materials in your affiliate console or create your own, as long as they meet section 11.
7.3 Everything you say about Landlord Vision must be accurate, honest and up to date, including prices, features and offers.
8. Paid advertising (PPC) and brand bidding ban
8.1 All Paid Advertising is prohibited. You must not use pay-per-click (PPC) or any other Paid Advertising to promote Landlord Vision, or to send traffic to a Landlord Vision website directly or through your Affiliate Link. This includes any paid ads on Google, Bing (Microsoft Advertising), Yahoo, DuckDuckGo or any social media platform.
8.2 The ban also covers Paid Advertising that sends people to your own website, content or landing page, where that page promotes Landlord Vision or contains your Affiliate Link.
8.3 No brand bidding on any platform. You must not bid on, buy or target any Brand Terms on any platform, for any purpose. This includes search engines, social media, app stores, marketplaces and comparison sites, and ads for your own business or other products. You must not use Brand Terms in ad copy, headlines, display URLs or sponsored posts.
8.4 You must not get around this section through anyone else, such as an agency, contractor, sub-affiliate, partner or another account.
8.5 You must not create ads, social media accounts or web pages that could make people think they are dealing with Landlord Vision itself.
8.6 No commission is payable on any referral that came from Paid Advertising or brand bidding. This applies whether or not our affiliate platform flags the referral.
8.7 If you break this section, we may cancel commission on the affected referrals, end this agreement immediately under section 13.2, and block you from rejoining under section 3.4.
8.8 This section does not restrict unpaid, organic promotion through your own channels under section 7.
9. Prohibited activities
You must not:
- refer yourself, your business, family members or anyone in your household, or buy a subscription through your own Affiliate Link
- offer cashback, rebates or part of your commission to people to sign up
- send unsolicited emails, texts or messages (spam), or market to people who have not agreed to hear from you
- use cookie stuffing, forced clicks, pop-ups, hidden links, bots or any method that sets a tracking cookie without a genuine click
- list discount or coupon codes we have not given you, or say an offer exists when it does not
- make false, misleading or exaggerated claims about Landlord Vision, its prices or its features
- promote Landlord Vision on sites or channels with illegal, hateful, adult or otherwise offensive content
- create fake customers, use stolen payment details, or do anything to generate commission dishonestly
10. Fraud checks and referral review
10.1 We and FirstPromoter check referrals for signs of fraud or breaches of these terms, including self-referrals, Paid Advertising traffic and unusually high refund or chargeback rates.
10.2 A flagged referral is not proof of wrongdoing. We will review it and may ask you to explain how the referral was generated, for example which ads, keywords or channels you used. You must reply within 14 days.
10.3 We aim to finish a review within 30 days of receiving your reply. We will then tell you whether the commission is approved or cancelled, and why.
10.4 If you do not reply within 14 days, or we find the referral broke these terms, we may cancel the commission on it.
10.5 Our decision after a review is final, acting reasonably and in good faith.
11. Our brand and marketing materials
11.1 We give you a limited, non-exclusive, revocable licence to use our name, logo and the marketing materials in your affiliate console, only to promote Landlord Vision under these terms.
11.2 You must not change our logo, or use our name or Brand Terms in your own domain names, business names, social media handles or app names.
11.3 We may ask you to change or remove any content that mentions Landlord Vision. You must do so within 5 working days.
11.4 All rights in our brand and materials stay with Landlord Vision Ltd. Your licence ends when your participation in the programme ends.
12. Disclosure and legal compliance
12.1 You must make clear that you earn commission when you promote Landlord Vision, for example by labelling posts "#ad" or "affiliate link". This must follow the UK CAP Code and Advertising Standards Authority guidance.
12.2 You must comply with all laws that apply to your marketing, including UK GDPR, the Data Protection Act 2018, the Privacy and Electronic Communications Regulations and consumer protection law.
12.3 You must not collect or pass to us personal data about Referred Customers. Landlord Vision handles customer data under its own privacy notice.
13. Suspension and termination
13.1 Either of us may end this agreement at any time by giving the other notice by email or through the affiliate console.
13.2 We may end this agreement immediately, without notice, if you break these terms. We may also suspend your account immediately while we investigate a suspected breach.
13.3 If this agreement ends for any reason other than your breach:
- we will pay commission earned on Qualifying Payments collected before the end date, on the next payment date under section 6
- commission under review at the end date will be paid if the review approves it
- no commission is payable on payments collected after the end date, even from customers you referred earlier
13.4 If we end this agreement because you broke these terms, you lose any commission not yet paid, and we may recover commission already paid on referrals that broke these terms.
13.5 When this agreement ends, you must stop using your Affiliate Link and our brand, and remove our marketing materials, within 5 working days. Sections 5.4, 12 and 15 continue to apply after it ends.
14. Changes to these terms
14.1 We may change these terms or the commission structure. We will give you at least 30 days' notice by email before a change takes effect.
14.2 Changes apply to referrals made after the change takes effect. Commission already earned under the previous terms is not affected.
14.3 If you do not agree with a change, you may leave the programme before it takes effect. If you stay, you accept the new terms.
15. General
15.1 Relationship: you are an independent contractor. Nothing in these terms creates a partnership, joint venture, employment or agency relationship. You are not our agent and may not make statements, promises or commitments on our behalf.
15.2 No exclusivity: this agreement is non-exclusive. You may promote other products and join other affiliate programmes. We may appoint other affiliates in any area, sector or channel.
15.3 We provide the programme and tracking as they are. We do not guarantee that tracking will be uninterrupted or error-free.
15.4 Limit on our liability: we are not liable for any indirect or consequential loss, or for any loss of profit, revenue, business or goodwill. Our total liability to you under or in connection with these terms is limited to the commission paid or payable to you in the 12 months before the claim. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
15.5 You will compensate us for losses we suffer because you broke these terms or the law.
15.6 Assignment: we may assign, transfer or novate this agreement, or any of our rights and obligations under it, to any person without your consent. This includes a buyer of all or part of our business or shares, or another company in our group. We will tell you if we do. You agree to sign any document reasonably needed to give effect to a novation. You may not assign or transfer this agreement without our written consent.
15.7 Governing law: these terms, and any dispute arising from them, are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction.
